The Punjab and Haryana High Court has appointed two court commissioners submit a report on the matter regarding which a plea has been filed by Indian cricketer and actor Yog Raj Singh, and singer, actor and former cricketer Hardavinder Singh alias Harrdy Sandhu.
The petitioners have pleaded for quashing of a letter (dated October 29, 2022) issued by Punjab Cricket Association (PCA) authorities vide which the honorary secretary, IS Bindra Stadium, Mohali, has called for special general meeting on November 20, 2022 without serving the petitioners any notice in that regard despite them being life members of PCA, the respondent association. The petitioners claim they are aggrieved, alleging that PCA’s actions are in contradiction to the rules and regulations of the body.
Appearing on behalf of the petitioners, senior advocates Amit Jhanji and Gaurav Chopra, with advocate Shashank Shekhar Sharma, claimed that a special general meeting held without issuing proper notice to the life members of the association is effectively denying them from participating in the said meeting despite them being entitled for it.
The HC issued notice to the respondent, PCA and Dilsher Khanna, honorary secretary, IS Bindra Stadium, for November 30, 2022. The notice was also issued regarding stay. However, the counsel of petitioners submitted that they are not pleading for any stay on the meeting at this moment and would be satisfied by the appointment of court commissioners to oversee the proceedings of the meeting. The counsel for petitions further submitted that the appointment of court commissioners will ensure free, judicious and impartial proceedings in addition to protecting their interests.
“The court commissioners shall be permitted to attend the meeting and the respondents shall extend cooperation. They shall submit their report of the proceedings to this court in a sealed cover,” Justice Bhardwaj said.
